TDI Complaints

TDI Complaints May Not Resolve Insurance Problems

When Texans feel wronged by insurance companies, they have the right to file a complaint with the Texas Department of Insurance (TDI). Unfortunately, filing a complaint with the TDI often will not resolve your insurance problem. If you are a policyholder facing an insurance claim dispute, consult a lawyer experienced in handling insurance claims.

About the TDI

The TDI is a state government agency responsible for regulating the insurance industry in Texas. When insurance agents and companies engage in unfair and unlawful practices, the TDI can impose fines or penalties. According to the agency, more than 30,000 TDI complaints get resolved each year. Yet, in some cases the primary action taken is a reporting of the complaint.

Filing a TDI Complaint

The TDI offers a few different options for filing an insurance complaint. You can file a complaint form online or print the form provided and send by email to ConsumerProtection@tdi.state.tx.us, by FAX to 512-475-1771, or postal mail to:

Texas Department of Insurance
Consumer Protection Section (MC 111-1A)
P.O. Box 149091
Austin, TX 78714-9091

After you submit your insurance complaint, TDI should send you an acknowledgment letter and notify the insurance company about your complaint. When the company responds, TDI should provide you with a copy of the response. After TDI determines if the insurance company handled your claim or other issue appropriately and if any laws were broken, you should receive notice of that decision.

Issues a TDI Complaint Cannot Resolve

TDI cannot resolve all complaints. For instance, TDI does not force the company to pay an insurance claim if a refusal to pay does not violate insurance laws. Nor does the agency determine who is responsible for an accident. TDI does not provide legal advice. For that, you will need to consult a Texas insurance lawyer.
